According to article 29, 59, 60, 61 and 62 from the Law on Public Procurement ("Official Gazette of the Republic of Macedonia”, No. 19/04), the Committee for Public Procurement of the Ministry of Culture, announces the following
INTERNATIONAL RESTRICTED TENDER No. 1/2007
I phase
1. GENERAL PROVISIONS
1.1 The procurer of the International restricted tender No. 1/2007 is the Ministry of Culture, with an address at “Gjuro Gjakovic” St., No. 61 – Skopje, Republic of Macedonia
1.2. International restricted tender No. 01/2007
1.3. Subject of the International restricted tender No. 01/2007 is collection of documentation for predetermination of the economic and financial, as well as technical capacity (prequalification) of the tenderers as possible holders of procurement, by collection of offers for the needs of the facility – museum complex Museum of VMRO and Museum of the victims of communism – Skopje, for the following:
- production of 40 (forty) wax statues and 5 scenes of people and events from the history of the Republic of Macedonia,
The subject of the procurement is non-dividable.
1.4. The tender is public, open and anonymous. All interested domestic and foreign legal and physical entities shall have the right to submit offers for the first phase of the International restricted tender 01/2007, provided that they collect the tender documentation and they are registered in the field of activities subject to this procurement.
The applications for offer with complete documentation by foreign tenderers should be originally written in Macedonian language or translated in Macedonian by an authorized court translator. The Macedonian version shall be the official version.
All expenses related to the preparation and submission of the offer shall be borne by the tenderer.
Furthermore, a group of tenderers which have concluded an agreement for business and technical cooperation may also apply. However, in this case, each of the tenderers shall be obliged to submit the necessary documents, which should be attached to the application for predetermination of the economic, financial and technical capacity of the tenderer.
1.5. The opening of the applications in the first phase shall be conducted without the presence of the tenderers. The Committee for Public Procurement shall decide upon the competence of the candidates, according to Article 62 from the Law on Public Procurement.
1.6. The period prescribed for submission of the offers shall be until 24.07.2007.
1.7. The Procurement shall be conducted in two phases in written form.
2. NECESSARY DOCUMENTS WHICH SHOULD BE SUBMITTED BY THE TENDERERS AS A PROOF OF THEIR ECONOMIC, FINANCIAL AND TECHNICAL CAPACITY
2.1 Presentation of the tenderer (name, address, seat, authorized person, telephone, and e-mail address).
- Documents regarding the economic and financial capacity:
2.2. Proof of economic and financial capacity: The domestic tenderers should submit a document for their solvency, issued by the Central Registry of the Republic of Macedonia. A foreign legal or physical entity, in the capacity of a tenderer, shall submit an Audit report, which should be positive and issued by a foreign reputable institution, registered for performing audits. The Audit report contains data regarding the total economic operation of the foreign tenderer for the last three years
2.3. Certificate from the Public Revenues Office for paid taxes, contributions and other liabilities or from an adequate body from the country of the tenderer, regarding payment of taxes, contributions and other payables;
2.4. Document for registered activity of the legal entity from the Central Registry or from the competent body from the country of the tenderer;
2.5. Operation permit (for field of activity) for a physical entity from a competent body;
2.6. Certificate that there is no bankruptcy procedure or liquidation;
2.7. Certificate that there is no issued valid decision prescribing a safety measure – prohibition of conducting activities;
THE DOCUMENTS FOR ECONOMIC AND FINANCIAL CAPACITY, except from the Audit report stated in sub-item 2.2 MUST NOT BE OLDER THAN 6 (six) months, and they shall be submitted in original or copy, according to Article 40, paragraph 5 from the Law on Public Procurement. Upon request of the procurer, if there is a submitted copy by a tenderer, he/she shall be obliged to submit the original document for inspection.

- Documents regarding the technical capacity:
- The technical and technological liquidity shall be expressed by:
2.8. A list of performed services and works of the type of services within the field for which they submit their offer, performed in the past three years, by stating the total value of the works and investors (reference list), according the terms from the tender documentation, verified and signed by the competent authority;
2.9. Certificate issued by a procurer for previous procurement of services form the same type for the last three years, stating the adequacy, timeliness and quality of realization of the services by the tenderer;
2.10. Statement regarding the technical personnel and other experts those work for the tenderer and who shall be responsible for the realization of the contract, as well as a statement of the persons competent for control and quality;
2.11. Description of the technical capacity of the tenderer and measures undertaken for provision of quality services, verified and signed by the competent person with the tenderer;
2.12. A list of produced wax statues and scenes of value, name of the investor, as well as the investor’s position regarding the quality and timeliness of the performance of the works.
2.13. Written statement for readiness of the tenderer that will be selected as most favorable, to furnish the service for the Ministry of culture of Republic of Macedonia, stamped and signed by the competent person of the tenderer
2.14. The mandatory documentation should be ordered and numerated according to the above stated order.
3. TERM AND MANNER OF SUBMISSION OF APPLICATIONS for the first phase of the International Restricted Tender No. 01/2007
3.1. The term for submission of the offers shall be at latest on 24.07.2007, until 12,00h.
3.2. Applications with complete documentation should be submitted in a closed envelope, on which a marking “do not open” and the number of the public call should be affixed in the upper left angle of the envelope. The correct address of the procurer with attention to the Committee for Public Procurement should be affixed in the middle of the envelope.
The envelope must not contain any labels that could identify the sender- tenderer.
3.3. The application shall be submitted in one original copy, verified (including archive number and stamp) and each page signed by the competent person of the tenderer.
3.4. The submission of the offers shall be to the procurer through postal service or by submitting the same in the archive of the procurer, within the Ministry of Culture, at “Gjuro Gjakovic” St., No. 61 – Skopje, Republic of Macedonia
4. ESSENCIAL CRITERIA FOR SELECTION OF QUALIFIED TENDERERS for phase I
4.1 Minimum annual turnover of finances of the tenderer in the last three years (2004, 2005 and 2006) for production of wax statues and scenes in the amount of MKD 120.000.000.00;
4.2 Minimum experience in identical or similar procurements in the last three years, with evidence - written statement from the tenderers for minimum of two realized contracts per year;
4.3 Minimum experience in identical or similar procurements in the last three years, for the stated professionals by a minimum of two realized contracts per year;
4.4 A list of equipment and technical means, private or rented, used for realization of at least two contract per year in identical or similar type of procurement, for the last three years;
4.5 Atests and certificates of quality, by which the tenderer proves its competence.
5. TERM FOR ADOPTION OF A DECISION ON QUALIFICATION OF THE CANDIDATES
5.1. The Committee for Public Procurement shall decide upon the competence of the candidates, according to the determined essential criteria.
5.2. The Committee for Public Procurement shall determine a list of most qualified candidates from the aspect of their economic, financial and technical capacity, according to which, the competent person of the procurer shall adopt a decision on the candidates, and shell invite them, with a written invitation, to submit their offers within a period of three months, counting from the deadline for submission of the documents for phase I of this tender.
5.3. The procurer, in term of ten days from the day of decision, informs all candidates that filed offers.
6. FINAL PROVISIONS
6.1. Each tenderer may participate only with one offer.
6.2. Additional information related to the International Restricted Tender No. 01/2007, as well as for collection of tender documentation may be obtained within the Ministry of Culture, each working day, from 11.00h to 14.00h, and on tel.: + 389 (0)2 3 240 577; + 389 (0)2 3 240 565.
6.3. The tender documentation for the first phase of the restricted public call may be obtained by any interested candidate, each working day from 09.00h to 15.00h within the Ministry of Culture, upon payment of non-refundable means in the amount of MKD 3.000 for domestic tenderers or EUR 50 for foreign tenderers.

Only tenderers who have collected tender documentation shall have the right to participate on this public call.
6.4. Applications with attached documentation which shall not be submitted within the prescribed period and those that have not been prepared according to the criteria of the International Restricted Tender No. 1/2007, as well as those with incomplete documentation, shall not be taken into consideration.
